Terms of Service

1. Who we are

Keen is a human capital management service ("Keen", "we", "us") operated by Keen Human Capital Management, a product of Dual IT Services. This website, keenhcm.com, describes the service. The application itself lives at mykeen.app and at each customer's own workspace, such as yourcompany.mykeen.app.

These Terms govern your use of the website and of any workspace your company creates through it. If you are using Keen as an employee invited by your employer, these Terms apply to you together with whatever policies your employer sets.

2. Agreement to these terms

By creating an account, inviting others to a workspace, or otherwise using Keen, you agree to these Terms. If you sign up on behalf of a company, you confirm that you have authority to bind that company. If you do not agree with these Terms, do not use the service.

3. What Keen does

Keen gives companies a single place to keep employee records, track attendance and schedules, manage leave requests, run Philippine payroll (including SSS, PhilHealth, Pag-IBIG and BIR withholding computations), handle expense reimbursements, publish announcements, store documents, generate reports, and produce year-end forms such as BIR 2316. The scope depends on the plan your company subscribes to.

4. Accounts and workspaces

  • You must give accurate information when signing up and keep it current.
  • Each company gets one workspace on its own subdomain. Company owners are responsible for who they invite and what access they grant.
  • You are responsible for keeping passwords safe and for activity that happens under your account. Tell us right away if you suspect unauthorized use.

5. Subscriptions, billing and renewal

  • Plans are priced per employee and billed monthly or annually. Current prices appear during signup.
  • We accept payments through PayMongo (card, GCash, Maya) and, for some customers, manual invoicing.
  • Subscriptions renew each period until cancelled. We issue renewal invoices before the period ends.
  • If payment fails or an invoice stays unpaid after reminders, we may suspend the workspace until the balance settles.

6. Your people and the data you enter

Employers decide what information about their employees goes into Keen — names, contact details, compensation, schedules, government ID numbers, bank accounts, attendance and so on. As the employer, you confirm that you have a lawful basis to collect this data and to let us process it on your behalf, and that you have told your employees how their data is used. We process that data only to run the service for you.

7. Acceptable use

Do not use Keen to break the law or anyone's rights; try to access other companies' workspaces or data; probe, scan or disrupt the service; scrape or resell the product; upload malware; or misrepresent who you are. We may suspend accounts that put our other customers, their employees, or the platform itself at risk.

8. Payroll figures and government forms

Keen computes contributions, deductions and withholding based on rate tables we maintain against current government rules, and generates forms such as payslips and BIR 2316 from the data entered into the system. You remain responsible for reviewing payroll before approving it, and for filing anything that must be filed with agencies on time.

Keen does not provide legal, tax or accounting advice.

9. The Keen Assistant

Where available, the Keen Assistant answers questions using your company's own records and respects the permissions attached to whoever asks. It can be wrong about details, and it never overrides the need to double-check figures before running payroll. Don't treat its answers as advice.

10. Availability and support

We work hard to keep Keen available and fix problems quickly, but the service is offered as-is under these Terms and we don't promise uninterrupted operation. Planned maintenance will usually happen outside Philippine business hours.

11. Your data belongs to your company

Employee and company records in your workspace belong to your company. You can export them while your subscription is active. If a subscription ends, we make the workspace read-only and delete its contents after a grace period, except where law requires us to keep something longer. 12. Intellectual property

Keen, including the software, design, brand assets and content of this website, belongs to us or our licensors. Nothing in these Terms transfers ownership to you. You keep all rights to the data you and your employees place in the service.

13. Limitation of liability

To the extent permitted by law, neither party is liable to the other for indirect, incidental or consequential losses, and our total liability for any claim related to the service is capped at the fees your company paid us in the twelve months before the claim.

14. Ending a subscription

Either side can end things: you can stop subscribing at renewal time, and we can suspend or terminate accounts for non-payment or serious breaches, with notice where practical. When a subscription ends, features requiring an active plan stop working.

15. Changes to these terms

We may update these Terms as the product evolves. Material changes will be announced through the service or by email to account owners ahead of taking effect. Continuing to use Keen after changes take effect means you accept the new version.

16. Governing law

These Terms are governed by the laws of the Republic of the Philippines. We'll first try to settle any dispute in good-faith discussion; if that fails, courts in the Philippines have jurisdiction.
